PAY WITH GASBUDDY E-SIGN CONSENT
1. ELECTRONIC DISCLOSURES
In connection with the Pay with GasBuddy+ Card Program, we are required by law to provide you with certain communications and disclosures in writing. This Pay with GasBuddy E-Sign Consent (“E-SIGN Consent”) allows GasBuddy, on behalf of itself, its affiliates, and any service providers (“We,” “Us,” or “Our”), to provide you with electronic versions of communications, notices, agreements, statements, or disclosures (“Communications”) associated with your Pay with GasBuddy+ Card Account (the “Services”).
By submitting an application and opening a Card Account, you agree (a) that you reviewed this E-SIGN Consent, (b) to receive Communications electronically on Our website (“Website”) or in the Pay with GasBuddy mobile application (“App”), electronically to the email address you have provided to Us, or by text to the mobile telephone number that you have provided to Us, and (c) to the use of electronic signatures. This consent applies to all Communications electronically that relate to all future transactions you conduct with your Card and Card Account.
All Communications from Us in electronic form shall have the same meaning and effect as if provided in paper form, regardless of whether you actually view the Communications. In addition, We may execute Communications electronically, and if We request, you will execute Communications electronically. You agree that Communications you or We sign electronically will have the same legal effect as a signed physical document.
By providing your consent to this E-SIGN Consent, you also confirm that you are able to access all of the Communications in electronic form.
If you choose not to consent to this E-SIGN Consent or if you withdraw your consent to this E-SIGN Consent, you may be unable to use the Services.
2. COMMUNICATIONS THAT ARE COVERED
Examples of Communications include:
• Any disclosure statement governing your use of the Services
• Billing statements, receipts, account history reports, and periodic statements
• Letters, notices, and alerts regarding the Services and any changes to the Services
• Any disclosure required by law
• Federal and state tax statements and documents
• Other disclosures, notices, and communications in connection with your application for the Services, your Card Account, account maintenance, or collection of funds
3. MINIMUM REQUIREMENTS
In order to access, view, and retain electronic Communications, you will need the following:
• A computer or mobile device with Internet or mobile connectivity.
• For application-based communications, a mobile phone operating system that supports downloads, and applications from the Apple App Store or Google Play store.
• A valid email account and access to the email address used to create a Card Account for the Services.
• Sufficient storage space to save Communications and/or a printer to print them.
• If you use a spam filter that blocks or re-routes emails from senders not listed in your email address book, you must add the @gasbuddy.com domain to your safe sender list.
• For website-based communications accessed by a computer, the computer must have a current operating system and compatible web browser, including the current or immediately preceding version of Chrome, Internet Explorer, Firefox, Safari and Edge.
4. ACCESSABILITY
We will send you an email when a Communication is first posted to Our Website or within the App, letting you know that it is now available. Communications will be available to you for at least 180 days following the date it is first posted or the date We send the email to you, whichever is later. To access Communications, you will need to use the agreed upon security procedures.

5. WITHDRAWING CONSENT
You are free to withdraw your Consent at any time. If at any time you wish to withdraw your Consent, you can:
• Disable electronic Communications in the App or on the Website by visiting https://help.gasbuddy.com/hc/en-us/articles/9879991341847-How-to-Unsubscribe-from-Emails. To adjust your email preferences, please find the unsubscribe button at the bottom of the GasBuddy email you received (this option will not be available on Transactional Emails).
• Alternatively, you can log into gasbuddy.com, and then click 'My Account' from the menu drop-down in the top right corner. Along the left, under your profile information, you will see 'Email Preferences'. Here you can select from a list of options for managing your email preferences. You will also be presented with the option to unsubscribe at the very bottom of all emails that GasBuddy sends to you. Please note- unsubscribe requests may take up to 48 hours.]. We will confirm when you have successfully unsubscribed; or
• Send us your request by submitting a written request to us at GasBuddy, 14241 Dallas Parkway, Suite 350, Dallas, Texas 75254 Attn: GasBuddy Customer Support. – Legal.
Any withdrawal of your Consent will be effective after We have had a reasonable period of time to process your request. The legal effectiveness, validity and/or enforceability of electronic Communications We sent before your withdrawal becomes effective will not be affected.
If you withdraw your Consent, We may close or limit access to your Card Account.
6. REQUESTING PAPER COPIES
You may print copies of the Communications by using the “print” or “save” functionality of the application in which are viewing the Communications (e.g., Web browser).
You can make a request paper for paper copies of Communications that have been provided to you electronically (such as periodic statements or Our privacy policy) by writing to Us at GasBuddy, 14241 Dallas Parkway, Suite 350, Dallas, Texas 75254 Attn: GasBuddy Customer Support – Legal, and specify in detail the Communication you would like to receive in paper form, and your current mailing address.
7. UPDATING YOUR INFORMATION
You agree that it is your responsibility to notify Us of any changes to your primary email address, phone number, or any other contact information so that We can communicate with you electronically.
You agree that if We send you electronic Communications but you do not receive it because your valid phone number or email address or other contact information is incorrect, out of date, blocked by your service provider, filtered as “spam” or “junk mail”, there is a malfunction in your computer, mobile device, browser, internet service , mobile connectivity and/or software, or you are otherwise unable to receive electronic Communications, We will be deemed to have provided the Communications, and We will not be responsible, nor assume any liability for non-receipt.
It is your responsibility to provide Us with true, accurate and complete mobile number, e-mail address, contact, and other information related to the Services, and to maintain and update promptly any changes in this information.
